ARTICLE 1 - GENERAL PRINCIPLES & CONTACT DETAILS OF THE PROCESSING MANAGER

The not-for-profit organisation ‘Wallonia Belgium Tourism’, abbreviated as WBT, whose head office is established at 1000 Brussels, rue Marché aux Herbes, 25-27 and whose operating head office is established at 5000 Namur, avenue Comte ae Smet de Nayer, 14, registered with the ECB under the number 0888.366.085, (hereinafter referred to as "WBT") operates the websites accessible at the following URL addresses (hereinafter referred to as the "Sites"):

1.2. WBT is responsible for processing personal data (hereinafter referred to as "Personal Data") processed during your visit to the Sites and your use of the services offered there, as defined in the general conditions of use of the Sites (hereinafter referred to as "Services").

1.3. All Personal Data collected by WBT, as the data controller, is processed in accordance with Belgian and European regulations applicable to the protection of personal data, and in particular:

- Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95 / 46 / EC (hereinafter referred to as "GDPR");

- The law of 30 July 2018 on the protection of individuals with regard to the processing of personal data.

1.4. In the context of this Charter, the term "Personal Data" means any information which, alone or in combination with other information available to WBT makes it possible to identify you directly or indirectly.

Concepts such as "processing", "controller", "processor", "data subject", "recipient", "consent", etc. have the meaning given to them by the GDPR.

1.5. You are invited to read this Charter carefully and to study its content.

ARTICLE 2 - PURPOSE OF THIS CHARTER

2.1. The purpose of this Charter is to inform you about the processing of your Personal Data when you visit the Sites and / or use the Services offered there.

2.2. This Charter is effective on the date mentioned above. It may be subject to change, so WBT invites you to check its content regularly.

2.3. This Charter may be supplemented by specific contracts or clauses intended to cover a particular aspect of your relationship with WBT, when it is necessary to provide you with more information as to how WBT processes your Personal Data.

ARTICLE 3 - CATEGORIES OF PERSONAL DATA LIKELY TO BE PROCESSED

When you visit the sites and / or use the services offered there, WBT may have to process the following categories of Personal Data:

- Identification data such as your first and last name, address, e-mail, gender, date and place of birth, professional data, etc. ;

- Technical data such as your IP address, browser, URL;

- Data collected via cookies (see below article 10).

ARTICLE 4 - PURPOSES OF PROCESSING AND DURATION OF RETENTION OF PERSONAL DATA

WBT is classified among the type 3 organizations referred to in the decree of December 15, 2011 on the organization of the budget, accounting and reporting of Walloon public administration units, to which public interest missions defined in article are entrusted 31 / 4.D. of the Walloon Tourism Code.

It is within the framework of these missions that the processing of your Personal Data is carried out. WBT may store your Personal Data for the entire duration necessary for the fulfillment of the purposes pursued and more particularly for the following purposes:

ARTICLE 5 - LEGAL BASES FOR THE PROCESSING OF PERSONAL DATA

5.1. Depending on the purposes pursued, WBT will be required to process your personal data:

- To carry out its public interest missions;

- To ensure the proper execution of a contract concluded with it;

- To comply with a legal obligation to which it is subject;

- Based on your consent.

5.2. If the processing is based on your consent, WBT will only use this Personal Data for the purpose (s) for which you have consented. When you have given your consent, you can withdraw it at any time by sending a letter or e-mail to the addresses mentioned in article 12 of this Charter or, in the case of newsletters, by clicking on the "unsubscribe" tab.

ARTICLE 6 - RECIPIENTS OF PERSONAL DATA

6.1. For the achievement of the purposes described in article 4, WBT may transmit your Personal Data to the following third parties (hereinafter referred to as the "Recipients"):

i. The partners with which WBT collaborates in the execution of its public interest missions:

- all regional, federal and community administrations and bodies in the exercise of their missions;

- any player in the tourism, cultural, hotel and catering sector and professional associations.

ii. WBT employees in Belgium and abroad in the exercise of their function.

iii. Subcontractors and external service providers for the fulfillment of the purposes pursued as provided for in article 4.

6.2. Your Personal Data will be kept in Belgium or in any other country in the European Economic Area. In this case, your personal data benefit from the same level of protection.

Certain processing operations may involve transfers to recipients established outside the European Economic Area, in which case we will ensure that these recipients offer appropriate guarantees in order to protect your data according to standards equivalent to those imposed by European legislation (GDPR).

6.3. The sites may contain links to third-party sites, and some of the services offered may give you access to third-party services.

WBT is not, however, responsible for these third-party sites and services or their privacy practices. WBT therefore refers you to the data protection declarations of these third-party sites or services.

6.4. WBT may be required to disclose your personal data if it proves necessary on the one hand, in order to comply with applicable laws or comply with an order or injunction from the Courts and Tribunals and / or on the other hand, to protect and defend its rights or those of users of the sites.

ARTICLE 7 - RIGHT OF OBJECTION

7.1. You have the right to object, at any time, for reasons relating to your particular situation, to the processing of your personal data. If personal data is used for commercial prospecting purposes, you may object without having to state the reason.

This right can be exercised by sending a letter or an e-mail to the addresses mentioned in article 12.

7.2. You do not however have the right to prevent WBT from continuing the processing of your Personal Data:

- If this is necessary for the execution of a contract concluded with you;

- If this is required by the legislation in force;

- If the processing is necessary for the establishment, exercise or defense of legal claims.

ARTICLE 8 - RIGHT OF ACCESS, CORRECTION, DELETION AND RIGHT TO LIMIT PROCESSING

8.1. You have a right of access to the information that WBT holds about you. This right gives you the opportunity to request a copy of all or only part of your Personal Data, if you wish.

8.2. You can also ask WBT to correct the information that you consider to be incorrect.

8.3. You also have the right to request the erasure of your Personal Data as well as the limitation of the processing operated by WBT on said Personal Data, and this subject to article 7.2.

8.4. These rights can be exercised by sending a letter or e-mail to the addresses mentioned in article 12.

ARTICLE 11: SECURITY

In order to ensure the protection of the personal data processed, WBT has set up a program for securing the information stored in its systems. In addition, its IT systems have a "new generation" software protection device.

ARTICLE 9 - RIGHT OF PORTABILITY

9.1. You also have the right to receive personal data which concerns you and which you have provided to WBT in a structured, commonly used and machine-readable format and the right to transmit it to another data controller when the processing of Personal Data is based on your consent or a contract and performed using automated processes.

9.2. These rights can be exercised by sending a letter or an e-mail to the addresses mentioned in article 12.
